Are you a small miniature model business from outside of the EU and need to make your products GPSR compliant and need an EU representative?
The General Product Safety Regulation (GPSR) is a regulation entered into force in 2023, it’s 18 month transition period ending on December 12th 2024. From December 13th, every item sold in the European Union needs to conform to this regulation.
This comes with a lot of needed information on online product listings as well as on the physical products, documentation for every product, including a risk assessment for product safety, and furthermore, if you’re a business outside of the EU, you need an EU representative if you intend to continue to sell your products to EU customers.
If you’re missing any vital information, you risk warnings due to anti-competitive behaviour with a fine and a cease and desist declaration from lawyered-up competitors. And if you’re missing an EU representative but continue to sell to EU customers, you risk fines from EU member states.
It seems this regulation has flown under the radar of quite a lot of small miniature hobby manufacturers and is hitting them just now out of the blue and completely unprepared.
I run a small miniature 3D printing business myself and have been in the miniature hobby quite a while, and have been implementing the needed information for my own products.
I have also been running with a manufacturer of medical devices for over 10 years before turning 3D printing into my full time job. New and unwieldy regulations are nothing uncommon in this field, so this was just another “thing to be done” for me.
The miniature hobby thrives from small garage workshops and single person companies. I would hate to see anyone get hit with an unfair fine that forces them to close down or pull out of the EU market.
So I would like to offer my help for this new regulation and offer myself to be your EU representative if you are
outside of the European Union
a small business with miniature models that you either produce yourself or let someone else produce for you (i.e. you’re NOT a reseller)
NOT a merchant of the same 3D files I also print and sell due to possible conflicts of interest
There are certain obligations this regulation puts on an EU representative, namely
making sure that each product confirms to the regulation
making sure every product has a technical documentation with all needed information and is up to date
being the first contact for EU market surveillance authorities
keeping a backup of the technical documentation for the products at hand if market surveillance authorities request them
I will offer the following if you hire me to become your EU representative
you can put my name, address and contact as an EU representative on your listings and products
I will help you understand the regulation and what it means for your business
I will help you with all the information you need to put on the listings and products
I will offer you a template for the technical documentation
I will keep you up to date with any new developments or changes regarding this regulation
What I am NOT as your EU representative
a sales contact for customers
liable for any fines, damages or other legal “trouble”
If you’re inside the EU (and therefore don’t need an EU representative) but are also completely lost with this regulation, just contact me too, I’m sure I can help you figure out what you need to do.
Please note that I am not a full-time “pro” at this, but just someone who wants to help out small businesses in the same hobby I’m in. I know regulations, I know documentations and this is not the first regulation that I implemented into products, but it is the first time doing it as a service.
I will charge 120 € / year to be your EU representative.
The prices are net prices. Inside the EU, according to the reverse charge system, tax liability transfers to the recipient of the services. Outside of the EU, tax liability also transfers to the recipient of the services. It’s your responsibility to pay the applicable taxes to your country’s authorities.
